The Chapter 7 Timeline, Filing to Discharge

From the day we file to the day your discharge enters is typically about four months. Two dates carry real weight: the 341 meeting roughly a month after filing, and the discharge about sixty days after that meeting.

Everything else is preparation and waiting. The waiting is uneventful, which is exactly what you want.

Before filing

The prep phase is the part you control, and it usually takes two to four weeks. We need six months of pay stubs, two years of tax returns, current statements on every account, a vehicle payoff, and your completed credit counseling certificate, which is an online course of about an hour that has to be finished within 180 days before filing. Cases stall here more than anywhere else. A missing tax return is the usual culprit.

StageTypical timing

Financial management course completedAny time after filing, before discharge
341 meeting of creditorsRoughly 21 to 40 days after filing

Discharge enteredUsually 60 to 75 days after the 341
Case closedDays to weeks after discharge in a no-asset case

The day you file, and the 341 meeting

The automatic stay starts the moment the petition hits the docket. Garnishments stop, calls stop, a scheduled trustee's sale stops, and a pending lawsuit freezes. We notify a garnishing employer's payroll department directly rather than waiting for the court's notice to work its way through the mail.

The 341 meeting itself is held by video in the Central District. It is not a hearing, no judge attends, and it typically lasts five to ten minutes: the trustee confirms your identity, asks whether you read and signed the schedules, then runs a short list of standard questions about property, transfers and expected inheritances. Creditors almost never appear. Bring government photo identification and proof of your Social Security number, because without them the trustee continues the meeting and your discharge slides a month for a paperwork reason.

“Clients spend weeks dreading the 341 meeting. Then it ends and they say some version of the same thing. That was it? Yes. That was it.”

Naomi Reyes-Ashford

What can push a case past four months

  • A continued 341 meeting for missing documents or identification
  • A trustee investigating an asset, which can hold a case open for months while property is administered
  • An adversary proceeding filed by a creditor alleging fraud
  • A U.S. Trustee inquiry into the means test in an over-median case
  • Amendments to the schedules after a creditor turns up late
  • Forgetting the second course, the financial management certificate, which has to be filed before discharge and is the most preventable way to lose one

Questions we get asked

Can the case go faster if I'm about to be garnished?

Yes. An emergency petition can be filed with the core forms in a day or two, with the full schedules following within 14 days. The stay begins on the filing date either way.

Do I have to go to a courthouse?

Not for a routine case. Consultations and 341 meetings are conducted by video, which for a client in Riverside or Santa Barbara saves most of a day.

When can creditors start calling again?

They cannot, on any discharged debt, ever. If a collector calls after discharge on a listed account, send us the details.

How soon can I rebuild credit?

Secured cards approve within weeks of discharge and auto financing is usually available within six to twelve months. Mortgage programs generally measure two years from discharge.

What to do next

Order your two most recent tax return transcripts from the IRS today, since that request takes longer than anything else on the document list. Everything else can be assembled while you wait for them.
