The California Homestead Exemption

California protects somewhere between roughly $371,000 and $744,000 of equity in your home, and you do not have to record anything to get it in bankruptcy. The number depends on the median sale price in your county.

Here is the part other firms leave out. No state agency publishes an official, current, county-by-county chart of that indexed figure, and no published decision has settled exactly how the median is supposed to be calculated. The most important number in your case is, to a degree, an argument.

How the number is built

Section 704.730 sets a floor and a ceiling. The floor started at $300,000 and the ceiling at $600,000, and both are adjusted for inflation each year. Applying the adjustments through 2026 puts the range at roughly $371,000 on the low end and roughly $744,000 on the high end.

Between those two poles, your exemption equals the countywide median sale price of a single family home in the year before you claim it. In Los Angeles County that median has been high enough for years that most filers land at or near the ceiling. In a cheaper county you might sit closer to the floor. Either way you never get less than the floor and never more than the ceiling.

The honest problem with the median

The statute says countywide median sale price. It does not name a data source. Zillow, Redfin, the California Association of Realtors and the county assessor will each give you a different number for the same county and year, sometimes tens of thousands of dollars apart. Trustees know this. So when the figure actually matters in a case, we document the source we relied on in advance rather than getting asked about it under oath.

Equity, not value

Take the current market value. Subtract the mortgage, the HELOC, any tax lien and any judgment lien that has attached. What is left is what the exemption has to cover. A $1.4 million house in Sherman Oaks with $1.1 million of debt against it has $300,000 of equity, which is comfortably inside the exemption, and the trustee has no interest in it.

Costs of sale matter too. A trustee who sells your house pays a broker, pays escrow, pays your exemption in full, and only then has money for creditors. If the arithmetic leaves the estate with $12,000, most trustees will not bother. That gap is real, but it is not something to bet the house on, and I do not build plans around a trustee being lazy.

You do not need a recorded declaration to use it in bankruptcy

This confuses people constantly. California has two homesteads. The automatic one applies by operation of law and is the one that protects you in a Chapter 7. The declared homestead is a document you record with the county, and its main advantage shows up if you sell voluntarily, where it protects the proceeds for a period afterward. Recording one before filing does not increase your exemption.

Two federal traps that override California law

If you acquired your interest in the property within 1,215 days before filing, section 522(p) caps your homestead at a federal figure currently in the low $200,000s, adjusted every three years. Moving to California from a low exemption state and immediately buying a house does not work the way people hope.

Separately, section 522(o) reduces the exemption by any amount you moved into the home within ten years with intent to hinder or defraud creditors. Paying down your mortgage with a lump sum right before filing is exactly the fact pattern that statute was written for.

Questions we get asked

Do I lose my house if I file Chapter 7?

Usually not. Most homeowners who file have equity well inside the exemption, or no equity at all. The cases where a house is at risk are visible from the first consultation, and there are options other than filing Chapter 7.

Is the exemption doubled for a married couple?

No. The homestead applies to the homestead, not to each spouse. Two people who own one house share one exemption. This surprises nearly every couple I meet with.

What if my county median changed this year?

The exemption is measured for the year in which you claim it, using the prior calendar year's median. In a market that moved sharply, filing in December versus January can change your number, and that is worth checking before we pick a filing date.

Does the exemption cover a rental property?

No. It protects the place you actually live in. A duplex where you occupy one unit is a real question with a real answer, but a house you rent out entirely is not homestead property.

If you own a home in the Central District, get a current payoff statement from your lender and a realistic value from an agent who has sold nearby in the last six months, then bring both to a consultation. Those two documents decide most of the case.
